Our Terms of Service

Welcome to MedVenture Mexico (“MedVenture Mexico,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our services, which include facilitating medical treatments, travel arrangements, and coordination with independent third-party healthcare providers and related service providers in Mexico. By accessing, using, or engaging with any of our services, you (“Client,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of our services.


1. Introduction and Acceptance of Terms

Welcome to MedVenture Mexico (“MedVenture Mexico,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our services, which include facilitating medical treatments, travel arrangements, and coordination with independent third-party healthcare providers and related service providers in Mexico.

By accessing, using, or engaging with any of our services, you (“Client,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of our services.

2. Nature of Services Provided

MedVenture Mexico acts exclusively as a facilitator and coordinator between you and independent third-party service providers. Our services are limited to the following:

  • Medical Coordination: Facilitating communication, scheduling, and logistics for medical consultations, diagnostic tests, procedures, and post-treatment follow-up with accredited and independent healthcare providers (clinics, hospitals, doctors) in Mexico.
  • Travel Logistics: Assisting with arrangements for travel, including flights, accommodation (hotels, recovery homes), and local transportation in Mexico.
  • Planning & Estimates: Providing estimated costs for medical procedures and related travel, and assisting with pre-treatment planning.
  • Customer Support: Offering coordination and support services during your medical journey.

MedVenture Mexico Does NOT:

  • Provide Medical Services: We are not a healthcare provider, medical clinic, hospital, doctor, nurse, or any other medical professional. We do not offer medical advice, diagnoses, treatment, or medical opinions.
  • Guarantee Outcomes: We do not guarantee any specific medical outcomes, results, or the success of any medical procedure. Medical results are inherently individual and depend on many factors beyond our control.
  • Assume Liability for Third Parties: We do not own, operate, control, or assume liability for the services, actions, or omissions of any third-party healthcare providers, travel agencies, transportation services, or accommodation providers.
  • Act as Financial Institution/Escrow: We do not hold funds in escrow for medical procedures or act as a financial institution or trustee on your behalf for payments to third-party providers.
  • Endorse or Certify Providers: While we partner with providers that meet our internal standards, we do not endorse, certify, or guarantee the quality, safety, or suitability of any third-party provider’s services.
3. No Medical Advice and Client Responsibility for Medical Decisions

All information, recommendations, or referrals provided by MedVenture Mexico regarding healthcare providers, treatment options, estimated outcomes, or any other medical-related content are for informational and coordination purposes only. Such information does not constitute medical advice, diagnosis, or treatment.

You are solely and exclusively responsible for:

  • Consulting with qualified healthcare professionals (both in your home country and in Mexico) regarding your medical conditions, treatment options, and all medical decisions.
  • Making your own informed decisions about your medical care.
  • Obtaining independent medical advice and second opinions as you deem necessary.
4. Eligibility

To use our services, you must be at least eighteen (18) years of age and possess the legal capacity and competence to enter into a binding agreement. If you are under 18, you must have the explicit written consent of a legal guardian, and your guardian must agree to these Terms on your behalf.

5. Client Responsibilities

By using our services, you agree to the following responsibilities:

  • Accuracy of Information: Provide MedVenture Mexico and all third-party providers with accurate, complete, and truthful medical history, current health status, personal identification, and any other requested documentation. You acknowledge that withholding or providing inaccurate information may jeopardize your treatment and safety.
  • Medical Clearance: Obtain necessary medical clearance from your primary physician or other qualified healthcare professionals in your home country for both travel and the proposed medical treatment abroad.
  • Travel Documentation: Secure and maintain valid passports, visas, necessary vaccinations, and any other travel documentation required for entry into and exit from Mexico, and re-entry into your home country.
  • Travel Insurance: Obtain comprehensive travel insurance, including medical evacuation and cancellation coverage, prior to your departure. MedVenture Mexico strongly recommends this.
  • Adherence to Guidelines: Strictly adhere to all pre-operative, post-operative, and general treatment guidelines, instructions, and appointments provided by your healthcare providers in Mexico.
  • Financial Responsibility: Be solely responsible for all costs associated with your medical treatment, travel, accommodation, and any other services, as outlined in your service agreement and directly with third-party providers.
  • Compliance with Laws: Comply with all applicable laws and regulations of Mexico, your home country, and any other relevant jurisdiction during your medical journey.
6. Payments and Refunds

a. Booking Deposit:
To initiate the coordination and facilitation of your medical travel and procedure, you are required to pay a non-refundable Booking Deposit equal to a specified percentage (e.g., fifteen percent (15%)) of the estimated medical procedure price.

  • Purpose: This fee is charged as compensation for MedVenture Mexico’s administrative, coordination, and facilitation services, which include, but are not limited to, booking initial consultations, securing procedure dates, coordinating travel arrangements, and providing ongoing support.
  • Earned Upon Confirmation: This Booking Deposit is earned in full by MedVenture Mexico upon confirmation of your booking for our coordination services, regardless of whether the medical procedure ultimately takes place.
  • Provider Courtesy Discount (Discretionary): MedVenture Mexico may have arrangements with certain participating healthcare providers to offer a courtesy discount equal to the amount of the Booking Deposit, which may be applied to the provider’s total procedure cost at the time of treatment. This discount is offered solely at the discretion of the individual healthcare provider and is not guaranteed by MedVenture Mexico unless explicitly confirmed in writing by the provider. The Booking Deposit remains a fee for MedVenture Mexico’s services and is not held in escrow or on behalf of the provider.

b. Remaining Balance:
All remaining balances for medical services, travel, and accommodation are payable directly by you to the respective third-party providers (e.g., clinic, hospital, hotel, transportation service) in accordance with their individual billing terms and policies. MedVenture Mexico does not collect, process, or transmit payments for medical procedures or third-party services. We are not responsible for provider billing, refund policies, or financial disputes between you and third-party providers.

c. Payment Authorization:
By providing a payment method for the Booking Deposit and any other charges directly to MedVenture Mexico, you represent and warrant that you are authorized to use the designated payment method and authorize us (or our third-party payment processor) to charge your payment method for the total amount of your Booking Deposit and any additional agreed charges for our facilitation services.

d. Payment Terms:

  • Currency: All prices and estimates provided by MedVenture Mexico are typically listed in United States Dollars (USD) unless otherwise stated. You are solely responsible for any exchange rate differences, foreign transaction fees, or other charges imposed by your bank or payment processor.
  • Additional Costs: You are responsible for any additional costs that may arise during your medical journey, including but not limited to:
    • Costs for additional medical procedures, tests, or extended stays due to unforeseen medical complications.
    • Costs for extended accommodation, transportation, or other services due to travel delays or changes.
    • Personal expenses, meals, and incidental charges.

e. Refunds (MedVenture Mexico Services Only):

  • The Booking Deposit paid to MedVenture Mexico is non-refundable.
  • No refunds for MedVenture Mexico’s coordination services are issued for cancellations made within ten (10) days of your scheduled travel or procedure date.
  • For cancellations made outside the ten (10) day window, partial refunds for other specific MedVenture Mexico coordination services (excluding the Booking Deposit) may be considered at our sole discretion, subject to any non-recoverable costs incurred by MedVenture Mexico.
  • Third-Party Refunds: Refunds for medical services, travel, or accommodation are subject to the individual refund policies of the respective third-party providers. MedVenture Mexico is not responsible for issuing or processing such refunds. Non-recoverable third-party costs (including but not limited to hotel bookings, flight tickets, and pre-paid transportation) are excluded from any potential refunds from MedVenture Mexico.
7. Informed Consent and Assumption of Risk

By engaging with MedVenture Mexico’s services, you acknowledge and accept the following inherent risks:

  • Medical Risks: All medical procedures carry inherent risks, including but not limited to complications, adverse reactions, infection, unsatisfactory aesthetic or functional outcomes, and in rare cases, severe injury or death. Medical outcomes can vary significantly based on individual health conditions, adherence to pre/post-treatment instructions, and other factors. You acknowledge that you will obtain informed consent directly from your healthcare provider in Mexico for any medical procedure.
  • Travel Risks: International travel involves risks such as flight delays or cancellations, lost luggage, political instability, natural disasters, changes in local laws, language barriers, and cultural differences.
  • Unforeseen Circumstances: Unexpected medical needs, extended recovery periods, or other unforeseen events may lead to additional costs or changes to your travel plans.
  • Voluntary Participation: Your decision to undergo medical treatment abroad and utilize MedVenture Mexico’s services is entirely voluntary. You assume full responsibility for all risks associated with your medical journey and for obtaining appropriate medical and travel clearances.
8. Third-Party Providers

MedVenture Mexico partners with independent healthcare facilities, medical professionals, transport providers, and accommodation services that meet our internal standards of quality and accreditation where applicable. However:

  • Independent Relationship: You understand and agree that you enter into a direct contractual relationship with each third-party provider (e.g., the clinic for medical services, the hotel for lodging, the airline for flights).
  • No Control: We do not control, supervise, or direct the clinical judgment, professional conduct, or operational practices of these independent third-party providers.
  • Disclaimer of Liability: MedVenture Mexico expressly disclaims all liability for any acts, omissions, negligence, malpractice, service failures, or any other conduct of any third-party provider. All complaints, claims, or disputes regarding clinical or travel services must be addressed directly to the relevant third-party provider.
9. Limitation of Liability

No Guarantees: MedVenture Mexico shall not be liable for:

  • Any adverse medical outcomes, complications, or dissatisfaction with treatment results.
  • Any disruptions, delays, cancellations, or failures in travel or lodging services, including but not limited to flight delays, lost luggage, or changes in accommodation.
  • Any actions, omissions, negligence, or failures of third-party providers.
  • Any personal injury, property damage, or financial loss arising from your medical journey, except as directly caused by our gross negligence or willful misconduct in the provision of our coordination services.

Maximum Liability: To the fullest extent permitted by applicable law, MedVenture Mexico’s total aggregate liability for any claim, loss, or damage arising out of or related to these Terms or your use of our services (whether in contract, tort, or otherwise) shall be strictly limited to the amount paid directly to us by you for the specific coordination service in question that gave rise to the claim.

Exclusion of Consequential Damages: Under no circumstances shall MedVenture Mexico be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages (including, but not limited to, lost profits, lost revenue, loss of data, or costs of procurement of substitute goods or services), even if advised of the possibility of such damages.

10. Disclaimer of Warranties

MedVenture Mexico provides its services, information, and materials “as is” and “as available,” without any warranties or representations of any kind, whether express, implied, or statutory. To the fullest extent permissible pursuant to applicable law, MedVenture Mexico disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information. We do not warrant that our services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Force Majeure

MedVenture Mexico shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by events beyond its reasonable control (“Force Majeure Event”). Such events include, but are not limited to, acts of God, natural disasters (e.g., hurricanes, earthquakes, floods), war, terrorism, civil unrest, labor disputes, epidemics, pandemics, governmental restrictions, travel bans, or significant disruptions to transportation networks. In the event of a Force Majeure Event, MedVenture Mexico’s obligations will be suspended for the duration of such event, and we will use reasonable efforts to mitigate its effects.

12. Privacy and Data Security

Your privacy is critically important to us. We collect, use, and share your personal and medical data solely for the purpose of coordinating your medical care and travel. By using our services, you consent to the sharing of this information with relevant third-party providers as necessary to facilitate your journey. Your data is stored securely and handled in strict accordance with our separate Privacy Policy, which is incorporated by reference into these Terms. 13. Intellectual Property

All content on our website and provided through our services, including text, graphics, logos, images, software, and the compilation thereof, is the property of MedVenture Mexico or its content suppliers and protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.

14. Indemnification

You agree to indemnify, defend, and hold harmless MedVenture Mexico, its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your violation of these Terms.
  • Your use of our services.
  • Your interaction with any third-party providers.
  • Your negligence or willful misconduct.
  • Any inaccurate or incomplete information you provide to us or third-party providers.
15. Termination

We reserve the right, at our sole discretion, to cancel, suspend, or terminate your access to and use of our services at any time, with or without notice, if:

  • You breach any of these Terms.
  • There are health or logistical concerns that, in our judgment, materially affect your ability to undergo treatment or travel safely.
  • Circumstances beyond our control (Force Majeure) make it impractical or impossible to provide services.
  • A third-party provider withdraws their services or changes their policies in a way that impacts our ability to facilitate your journey.
  • We believe your actions may cause legal liability for us or other users.

Upon termination, your right to use our services will immediately cease.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Quintana Roo, Mexico, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration administered by a recognized arbitration institution in Quintana Roo, Mexico, in accordance with its rules. The arbitration shall be conducted in the English language. The decision of the arbitrator(s) shall be final and binding on both parties.

17. Severability and Waiver

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18. Entire Agreement

These Terms, together with our Privacy Policy and any specific service agreements or quotes provided to you, constitute the entire agreement between you and MedVenture Mexico regarding your use of our services and supersede all prior or contemporaneous understandings, agreements, negotiations, representations, and communications, whether written or oral.

19. Amendments

We may update or modify these Terms periodically to reflect changes in our services, legal requirements, or business practices. We will notify you of any material changes by posting the revised Terms on our website with a new “Last Updated” date. Your continued use of our services following the posting of any changes constitutes your acceptance of the revised Terms.
